2. SERVICES PROVIDED


Metro Maids NYC provides professional cleaning services in New York City, including:


• Commercial Cleaning: Office cleaning, janitorial services, and contract cleaning for businesses

• Post-Construction Cleaning: Rough cleaning, final cleaning, and touch-up services for new developments

• Private Residential Staffing: Live-in and live-out household staff for luxury residences


All services are subject to availability and scheduling. Service descriptions on our website are general in nature and may be customized based on client needs.



3. SERVICE AGREEMENT AND QUOTES


Quote Requests


When you submit a quote request through our website or contact us directly:

• Quotes are provided free of charge and without obligation

• Quotes are estimates based on the information you provide

• Final pricing may vary based on actual scope of work, property condition, and service requirements

• Quotes are valid for 30 days from the date provided


Service Agreements


• All services require a written or verbal agreement outlining scope of work, pricing, and schedule

• Service agreements may be modified only with mutual written consent

• We reserve the right to refuse service to any client for any reason

• Minimum service requirements may apply for certain service types



4. PRICING AND PAYMENT


Pricing


• Our standard rates range from $40-50 per hour depending on service type and scope

• Custom pricing is provided based on project requirements

• Prices quoted are in US dollars

• All prices are subject to applicable taxes


Payment Terms


• Payment is due upon completion of service unless otherwise agreed in writing

• Accepted payment methods: Check, cash, bank transfer, credit card (if applicable)

• For recurring services, payment terms will be specified in the service agreement

• Late payments may be subject to a fee of 1.5% per month or the maximum allowed by law

• We reserve the right to suspend services for accounts with outstanding balances



5. SCHEDULING AND CANCELLATIONS


Scheduling


• Services are scheduled based on mutual availability

• We will make every effort to accommodate your preferred schedule

• Emergency or rush services may be available at additional cost

• We reserve the right to reschedule services due to weather, emergencies, or staff availability


Cancellation Policy by Client


• Commercial/Residential Recurring Services: 24-hour notice required for cancellation

• Post-Construction Projects: 48-hour notice required for cancellation

• Cancellations with less than required notice may be subject to a cancellation fee of up to 50% of the scheduled service cost

• No-shows (failure to provide access or be available) will be charged the full service fee

• We reserve the right to cancel or reschedule services due to emergencies, weather, or other unforeseen circumstances

• We will provide as much advance notice as possible

• No fees will be charged for services cancelled by Metro Maids NYC



6. CLIENT RESPONSIBILITIES


To ensure quality service delivery, clients agree to:


Access and Entry


• Provide safe and timely access to the property

• Provide entry codes, keys, or access instructions as needed

• Ensure someone is available to grant access if required

• Notify us immediately of any access issues


Property Condition


• Ensure the property is safe for our staff to work

• Remove or secure valuable, fragile, or personal items

• Disclose any hazardous conditions, materials, or areas

• Provide adequate utilities (water, electricity) for cleaning

• For construction sites: Ensure work areas are ready for cleaning per agreed schedule


Special Requirements


• Communicate any special cleaning requirements, restrictions, or preferences

• Notify us of any allergies, sensitivities, or product restrictions

• Provide adequate notice of any changes to scope or schedule

• Ensure pets are secured or removed from work areas (if applicable)



7. OUR RESPONSIBILITIES AND SERVICE GUARANTEE

• Arrive on time for scheduled appointments (or notify you of delays)

• Provide trained, professional, and background-checked staff

• Use appropriate cleaning products and equipment

• Respect your property and maintain confidentiality

• Address any concerns or issues promptly


Service Quality


• We strive for excellence in every service we provide

• If you are not satisfied with our work, please notify us within 24 hours

• We will return to re-clean any areas that do not meet our quality standards at no additional charge

• Our satisfaction guarantee applies to the specific services agreed upon in your service agreement


Limitations


We are not responsible for:

• Pre-existing damage, stains, or conditions that cannot be remedied through standard cleaning

• Damage to items that are fragile, antique, or improperly secured

• Issues arising from client failure to disclose hazardous conditions

• Delays or inability to perform services due to client failure to provide access

• Results that exceed the scope of standard cleaning services without prior agreement



8. INSURANCE AND LIABILITY


Insurance Coverage


• Metro Maids NYC carries general liability insurance and workers' compensation insurance

• Our insurance covers damages or injuries that occur due to our negligence during service delivery

• Proof of insurance can be provided upon request


Liability Limitations


To the maximum extent permitted by law:

• Our total liability for any claim shall not exceed the amount paid for the specific service giving rise to the claim

• We are not liable for indirect, incidental, or consequential damages

• We are not liable for damage to items not disclosed or improperly secured by the client

• We are not liable for loss or damage to valuables, cash, jewelry, or personal documents

• Claims must be reported within 24 hours of service completion


Client Insurance


For commercial and construction projects, we may require clients to:

• Maintain property insurance covering the premises

• Name Metro Maids NYC as an additional insured (for construction projects)

• Provide certificate of insurance upon request



9. CONFIDENTIALITY AND PRIVACY


We respect your privacy and the confidentiality of your property:


• Our staff is trained to maintain strict confidentiality

• We will not disclose any information about your property, access codes, or personal matters

• For residential staffing, staff members sign confidentiality agreements

• We comply with all applicable privacy laws

10. STAFFING AND SUBCONTRACTING


Staff


• All Metro Maids NYC employees undergo background checks and professional training

• We maintain low staff turnover and strive to provide consistent teams

• We reserve the right to substitute staff as needed due to scheduling or availability


Subcontracting


• We may use subcontractors for specialized services or during high-demand periods

• All subcontractors are vetted, insured, and meet our quality standards

• We remain responsible for all work performed by subcontractors



11. TERMINATION OF SERVICES


By Client


• You may terminate recurring services at any time with 30 days' written notice

• Termination does not relieve you of payment obligations for services already rendered

• Outstanding balances must be paid in full upon termination

We reserve the right to terminate services immediately if:

• Payment is not received according to agreed terms

• Client violates these Terms of Service

• Client engages in abusive, threatening, or inappropriate behavior toward our staff

• Property conditions are unsafe or hazardous

• Client repeatedly fails to provide access or cancels without notice



12. INTELLECTUAL PROPERTY


All content on the Metro Maids NYC website, including text, graphics, logos, images, and software, is the property of Metro Maids NYC and is protected by copyright and trademark laws.


You may not:

• Copy, reproduce, or distribute our website content without written permission

• Use our name, logo, or branding without authorization

• Frame or mirror our website content on another website



13. DISPUTE RESOLUTION


Governing Law


These Terms shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law provisions.


Dispute Resolution Process


In the event of any dispute arising from these Terms or our services:


1. Informal Resolution: Contact us first to resolve the issue informally

2. Mediation: If informal resolution fails, disputes shall be submitted to mediation in New York, NY

3. Arbitration: If mediation fails, disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association

4. Legal Action: If arbitration is not successful, disputes may be brought in the state or federal courts located in New York County, New York


Class Action Waiver


You agree to resolve disputes with Metro Maids NYC on an individual basis only. You waive any right to bring claims as part of a class action, collective action, or representative proceeding.



14. LIMITATION OF LIABILITY


TO THE MAXIMUM EXTENT PERMITTED BY LAW:


• METRO MAIDS NYC'S TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID FOR THE SERVICE GIVING RISE TO THE CLAIM

• WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES

• WE ARE NOT LIABLE FOR DAMAGES RESULTING FROM CIRCUMSTANCES BEYOND OUR REASONABLE CONTROL

• SOME JURISDICTIONS DO NOT ALLOW LIMITATION OF LIABILITY, SO THESE LIMITATIONS MAY NOT APPLY TO YOU



15. INDEMNIFICATION


You agree to indemnify, defend, and hold harmless Metro Maids NYC, its owners, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney fees) arising from:


• Your violation of these Terms of Service

• Your violation of any law or regulation

• Your failure to provide a safe work environment

• Your failure to disclose hazardous conditions

• Claims by third parties arising from your use of our services



16. FORCE MAJEURE


Metro Maids NYC shall not be liable for any failure or delay in performing services due to circumstances beyond our reasonable control, including but not limited to:


• Natural disasters (hurricanes, floods, earthquakes)

• Acts of God

• Government actions or restrictions

• Epidemics or pandemics

• Labor disputes or strikes

• Utility failures

• Transportation disruptions


In such events, we will make reasonable efforts to notify you and reschedule services as soon as possible.



17. SEVERABILITY


If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.



18. ENTIRE AGREEMENT


These Terms of Service, together with our Privacy Policy and any written service agreement, constitute the entire agreement between you and Metro Maids NYC regarding our services and supersede all prior agreements, understandings, and communications.
